No airport development fee at Delhi for three weeks

New Delhi: The Delhi High Court on Wednesday provided interim relief to air passengers transiting in and out of Delhi international airport staying the levy of Airport Development Fees by the airport operator.  The court was hearing batch of petitions against the extra fee charged by Delhi International Airport Ltd (DIAL).

Currently, DIAL charges domestic flyers Rs200 and international travellers Rs1,300 as development fees.

A division bench comprising chief justice Dipak Misra and Justice Sanjiv Khanna, however, refused to adjudicate on the validity of ADF itself and asked the petitioners, instead, to challenge the levy before an aviation tribunal.

The court said the public notice was an 'ad hoc' order and could be challenged before the Airport Economic Regulatory Authority Appellate Tribunal, which should decide the petitions within 45 days.

With the court's order, DIAL has asked airlines to stop charging ADF with immediate effect.

The court was hearing two petitions filed by Resources of Aviation Redressal Association and Consumer Online Foundation against a public notice allowing DIAL to collect the charge.
