SC dumps telecos’ review pleas in 2G spectrum case
04 Apr 2012
The Supreme Court today dismissed all the review petitions filed by mobile service providers impacted by the court's order that revoked all telecom licences awarded in the 2008 2G spectrum sale. The SC, however, decided to hear a government petition seeking review of the verdict cancelling 122 spectrum licences, in an open court, on 13 April.
The governmet has challenged the Supreme Court's decision against the government's right to decide the mode of allocation, which it deemed fit at that time.
The SC, in its February judgement canceling all the 122 telecom licences awarded in the 2008 sale, had directed the telecom authorities to make fresh sale of the spectrum through auction.
The government is seeking a review of some of the observations made by the court in its order and not challenging the cancellation of licences.
A bench comprising Justices G S Singhvi and K S Radhakrishnan dismissed the review petitions filed by Videocon Telecommunications, S Tel, Sistema Shyam Teleservices, Tata Teleservices, Unitech Wireless (Tamil Nadu), Etisalat DB Telecom and Idea Cellular, insisting that it did not err in its judgement.
''We have carefully perused the review petition and the record of the case and are convinced that the judgment of which review has been sought does not suffer from any error apparently warranting its reconsideration,'' the bench said in separate orders on the review petitions filed by the seven telecom companies.
