Delhi court clears Yahoo on hosting objectionable content case

A Delhi court today dismissed a charge against Yahoo India for allegedly hosting objectionable content on its website and set aside a summons for initiating criminal proceedings.

Justice Suresh Kait set aside a summons issued against Yahoo India and allowed the plea of the internet giant that a metropolitan court wrongly issued the process against it, without attributing any specific role to it.

Yahoo was among 21 web firms, including Facebook and Google, accused of hosting material that could cause communal unrest.

Complainant Vinay Rai had filed a case against Yahoo and the metropolitan court had delivered an ex-parte order on 20 December, issuing summons to 21 social networking websites, including Yahoo, asking them to remove "anti-religious" or "anti-social" contents from their sites.

Yahoo had pleaded with the court to remove its name from the plaint, saying no cause of action was made out against it.

According to Yahoo India, the complaint and the order of the magistrate dealt with alleged objectionable material retrieved from various websites including Zombie, Orkut, Youtube, Facebook, Blogspot and none pertained to Yahoo.
