Delhi High Court bails out Avnish Bajaj

New Delhi: The Delhi High Court today granted bail to Avnish Bajaj, CEO, baazee.com, who had been arrested on Friday and remanded to a six-day custody on Saturday in the MMS sex video case, . Prior to granting reprieve to Bajaj, vacation judge, Justice Vikramajit Sen, had reserved orders on Bajaj''s application after hearing his lawyers, Arun Jaitley and DC Mathur and the Delhi Police advocate Mukta Gupta.

Gupta had opposed the bail application contending that the case was under investigated and the Delhi police may require Bajaj in custody during their interrogation. This was opposed by Jaitley and Mathur, who argued that the CEO of the website be enlarged on bail as no personal role has been attributed to him in the case.

They submitted there should not be any discrimination between an Indian citizen and foreign national in grant of bail and pointed out that Bajaj had voluntarily come from Mumbai to Delhi to assist the Delhi police.

Yesterday his counsel had contended that no case was made out against him under the ''information technology act'' and the ''Indian penal code'' as the website had not posted the objectionable material on its website. Jaitley had stressed that as soon as the website discovered the material, it was removed from the site.

The Delhi police had charged baazee.com with listing a sexually explicit MMS clip involving a minor schoolboy and his classmate on its site for sale on November 24.
