07 Dec 2009
The Delhi High Court today diasmissed healthcare and FMCG product firm Dabur India's application Godrej Sara Lee Limited in the Delhi Court, praying for a stay against Good Night Natural Mosquito Repellant Cream TV commercial.
Good Knight is the flagship brand of Godrej Sara Lee Limited.
Dabur, marketers of Odomos, had claimed that the Good Knight Natural Mosquito Repellant Cream TV commercial portrayed other mosquito repellant creams as causing rashes and allergy and not being skin friendly, while Good Knight with Natural ingredients was safe on skin.
While dismissing Dabur's interim application, the court upheld the right of Godrej Sara Lee to extol the virtues of its products. It relied on English and Indian case laws upholding Godrej's claim that it had theright to bring out the virtues of its own product.
Further, the court endorsed the Good Knight Natural Mosquito Repellant Cream TV Commercial as talking the benefits of natural ingredients like tulsi, lavendar, milk protien, etc, in its own product, saying it did not find any objectionable slogan or picture.
Godrej Sara Lee said in a press release that Good Knight has been a SuperBrand for the last three years.
