SC turns down interim relief for RPL against Allahabad High Court
19 Jan 2010
The Supreme Court on Monday turned down a plea for interim relief to Anil Dhirubhai Ambani Group (ADAG) against a judgment of the Allahabad High Court quashing the Uttar Pradesh Government's notification to acquire land for the proposed 8,000 MW Dadri power project.
A bench headed by chief justice K G Balakrishnan said the matter of grant of interim relief would be considered on 29 January after the deposition of some farmers who wanted to be heard in this matter.
According to senior counsel Mukul Rohatgi, appearing for Reliance Power Ltd (RPL) the group's corporate rivals were instigating farmers to file petitions against land acquisition.
He said the petitions were motivated and it was case of corporate rivalry.
He pointed out that the High Court had disposed off the petitions four years after the land allocation and in many cases farmers had already withdrawn the compensation amount.
He said that 5,287 farmers had agreed to the acquisition of their lands by the UP government and 90 per cent of them had accepted the amount of the compensation.
